General Terms and Conditions of Sale of Champagne Cuperly, SAS with a share capital of €1,000,000, registered with the Reims Trade and Companies Register under number B 311 168 876, with EU VAT number FR 77311168876, and headquartered at 2 rue de l’Ancienne Église, 51380 VERZY – FRANCE (hereinafter referred to as “Champagne Cuperly”).

1. Purpose and scope of the general terms and conditions of sale
These general terms and conditions of sale apply to sales concluded between Champagne Cuperly and any individual having reached the minimum legal age required to purchase alcohol (18 years old in France), or any legal entity, acting as a consumer or non-professional, that is, contracting solely for personal use and not for commercial resale or professional purposes (hereinafter “the Client”), wishing to purchase products distributed by Champagne Cuperly (the “Products”) via the online store accessible at the following address: https://www.champagne-cuperly.com/en/
In accordance with article L.3342-1 of the French Public Health Code, the Client declares being of legal age at the time of the sale and confirms, in the case of a purchase made by a third party, that the recipient is of legal age.
Online sales of the Products are reserved for Clients wishing to have deliveries made in mainland France or Corsica. For any request to ship these Products internationally, the Client must contact customer service directly: [email protected]
2. Placing orders and confirmation (util)
The Client wishing to purchase Products via the Website must necessarily complete the following steps:
- Select the Products by clicking on the desired items, indicate the desired quantity, and add them to the cart.
- Follow the order and validation steps by clicking the “order” button on the “cart” page.
- Create an account by filling in the identification form, indicating all required fields (name, surname, delivery address, billing address, phone number, email, etc.)
- Accept the general terms and conditions of sale by checking the box provided for this purpose after reading them. It is not possible to validate an order without full and unreserved acceptance of the general terms and conditions specified on the Site. This checked box thus constitutes acknowledgment by the Client of full awareness of them.
- Validate the order after verifying it.
- Proceed to payment for the order online.
Champagne Cuperly will acknowledge receipt of the order by displaying a confirmation message, which will include the order number (a summary email will be sent simultaneously to the Client).
Orders validated on the Site contractually bind the Client and Champagne Cuperly, constituting signature and acceptance of the terms of the commercial transaction. However, Champagne Cuperly reserves the right to suspend or cancel (I) any abnormally high order, (II) any order placed by a Buyer whose order frequency appears abnormal in relation to standard private client needs, (III) any order lacking the necessary delivery information, (IV) any order from a Client with a past dispute over payment of a previous order, or (V) any order from a client who lacks legal capacity. In this context, Champagne Cuperly reserves the right, before confirming an order, to ask the Client to provide proof of personal information. In the absence of compliant proof, Champagne Cuperly shall be entitled to cancel the order. In all cases, the Client will be informed by Champagne Cuperly. French is the only language offered for order processing.
3. Products offered for sale
- Stock
The Products are offered within the limit of available stock. In case of total or partial unavailability visible on the Site, please contact customer service (see article “Contact”). Champagne Cuperly also reserves the right not to validate an order in such cases.
If the Products become available after the delivery deadline indicated in the order confirmation, Champagne Cuperly will offer the Client the option either to cancel the order, or, subject to stock availability, to accept a product of equivalent quality and price, or to wait for delayed delivery of the ordered Product.
In case of definitive unavailability of one or more ordered Products not indicated on the Site, the Client will be informed as soon as possible and may cancel the order. In case of cancellation by the Client, Champagne Cuperly will refund the amounts paid using the same method of payment as that used for the order, within fourteen (14) days from the date of cancellation.
Champagne Cuperly reserves the right, at any time and at its sole discretion, to withdraw one or more Products from sale on the Site.
- Product description
Each Product presentation is accompanied by a description established by Champagne Cuperly. Photographs have no contractual value and do not in any way engage the responsibility of Champagne Cuperly.
A label change does not constitute a modification of a Product’s characteristics.
4. Price and payment
- Prices are expressed in euros (€), duties included and all taxes included (TTC), taking into account VAT and other applicable charges in France on the order date. Prices shown on the Site are therefore valid only for French residents. Any change in these tax rates may be reflected in the Product prices.
Champagne Cuperly reserves the right to change its prices at any time, without notice, provided that the price listed on the Site at the time of the order will be the one applicable to the Client.
Prices on the Site do not include shipping fees, which are set according to the scale below.

Due to the constant fluctuation in shipping prices by our carriers, Champagne Cuperly reserves the right to modify shipping fees at any time without notice, provided that the price listed on the Site at the time of the order shall apply to the Client.

Discounts and promotions cannot be combined and are limited to one per household (same name, same address).
Discounts for privileged members cannot be combined with other offers.

Promotional codes are not cumulative: only one code may be used per transaction.
- Payment for purchases at the all-inclusive price (taxes, order preparation, and delivery fees) is made by credit card (Visa, Mastercard) or Paylib.
Champagne Cuperly uses all available means to ensure the confidentiality and security of data transmitted on the Site. Online payment is processed through Crédit Agricole’s secure payment system, which guarantees that sensitive data is transmitted and stored according to the highest security and quality standards.
To complete payment, Crédit Agricole will request the following information: type of payment card (Visa, Mastercard), card number, expiration date, and security code along with the explicit debit authorization from the cardholder.
The transaction is immediately charged to the Client’s card after verification and authorization from the issuing entity.
In accordance with Article L. 132-2 of the French Monetary and Financial Code, the commitment to pay via card is irrevocable. By providing card information, the Client authorizes Champagne Cuperly to charge the all-inclusive amount. If payment is not possible, the Online Sale will be automatically canceled, and the Client informed.
5. Delivery
- Delivery is made by carrier to the address indicated by the Client when validating the order.
The Client must choose a delivery address located in mainland France or Corsica. The Client is solely responsible for any delivery failure or delay due to insufficient or incorrect information provided during the Order.
All costs incurred for re-shipment due to incorrect input by the Client shall be borne exclusively by the Client.
The delivery time will be indicated to the Client at the end of the Order process. In any event, the maximum delivery time from order confirmation is 2 to 10 days depending on product availability.
- The Client must check the condition of the parcels delivered and indicate any reservations to the carrier on the delivery slip before signing.
If reservations are made, even if clearly and precisely indicated, they must be confirmed in writing by registered letter with acknowledgment of receipt to the Carrier within the time limits from delivery, in accordance with Article L 133-3 of the French Commercial Code.
If the parcel is refused, the Client may request the Carrier to return it, which must be accompanied by a “report of spoliation,” of which the Client will keep a copy. The Client must also send a copy of this letter to the Seller. Failure to make a claim within the specified period and in the prescribed manner shall extinguish any action against the Carrier and the Seller in accordance with Article L. 133-3 of the Commercial Code.
Champagne Cuperly is only responsible for direct and foreseeable damages. Champagne Cuperly’s liability cannot be engaged after delivery to the Client, and without any reservation on their part.
- In case of delayed delivery, the Order is not canceled. The Seller will inform the Client by email that the delivery will be delayed.
If the Order has not yet been shipped upon receipt of the cancellation notice from the Client, the shipment is blocked and any payments made will be refunded within thirty days.
If the Order has already been shipped when the Client’s cancellation notice is received, the Client may still cancel the Order by refusing the parcel. The Seller will then refund the sums paid and the return shipping fees within thirty days from receipt of the returned parcel, complete and in its original condition.
6. Retention of title
Champagne Cuperly expressly retains ownership of the Products sold until full payment is received from the Client and effectively cashed by Champagne Cuperly.
7. Right of withdrawal
- Orders are firm, final, and not subject to modification or cancellation, except under the conditions set out in this Article 7;
- The Client has the right to withdraw from this contract without giving any reason within fourteen days from physical possession of the order by the Client or a third party designated by them. If the deadline falls on a Saturday, Sunday, or public holiday, it is extended to the next working day.
By exception, in accordance with Article L.221-28 of the Consumer Code, where the Products ordered are sealed, they are not subject to the right of withdrawal once unsealed by the consumer after delivery, for reasons of hygiene or health protection.
Similarly, Products that have been opened or whose labels have been damaged, that are incomplete, damaged, spoiled, or soiled, will not be taken back. Any Product that has been altered will neither be refunded nor exchanged.
- To exercise the right of withdrawal, the Client must notify Champagne Cuperly, using the contact details in the “Contact” article, of their decision to withdraw by means of a clear statement (e.g., letter sent by mail or email) and must return the Products within the aforementioned period in their original packaging, complete, new. Return costs are the responsibility of the Client.
- In the event of withdrawal, Champagne Cuperly will refund all payments received, including delivery costs (except additional costs if the Client has chosen a more expensive delivery method) upon receipt of the item or proof of its return, whichever comes first. Refunds will be made using the same payment method as the original transaction unless another method is expressly agreed upon. No fees will be charged to the Client, except for return shipping costs.
8. Claims and returns under warranty
- Non-compliance with the Order
The Client has a period of five (5) calendar days from the delivery date to return non-compliant Products to Customer Service. Any non-compliant Product must be returned in its original, unopened packaging, with a copy of the invoice and any other documents provided.
The consumer will be reimbursed for return postal costs no later than thirty days following receipt of the Product by Champagne Cuperly.
- Return of defective Products
In case of defective Products, the Client must contact Customer Service at the address listed in the “Contact” article of these T&Cs within twenty-four (24) hours of receipt, without prejudice to any recourse against the carrier if necessary.
9. Warranties
The Seller is bound by the legal warranty of conformity as defined in Articles L. 217-4 et seq. of the Consumer Code and by the warranty for hidden defects as defined in Articles 1641 to 1649 of the Civil Code.
When acting under the legal warranty of conformity, the Client has two (2) years from delivery to take action (Article L. 217-12 of the Consumer Code); they may choose between repair or replacement of the goods, subject to cost conditions under Article L.217-9.
Under Article L. 217-7, defects that appear within twenty-four (24) months of delivery are presumed to exist at the time of delivery unless proven otherwise.
The legal warranty of conformity applies independently of any commercial warranty.
The Client may also implement the warranty for hidden defects as per Article 1641 of the Civil Code; in that case, they may choose between rescission of the sale or a price reduction under Article 1644.
Under Article 1648, the Client has two (2) years from discovering the defect to act. However, the action must also be brought within five (5) years of the sale.
10. Force majeure
Champagne Cuperly reserves the right to cancel any order and is released from any obligation in case of force majeure or failure of its suppliers, natural disasters, acts of government, or any circumstances that prevent the manufacture or delivery of supplies. Events such as strikes, fires, floods, equipment breakdowns, pandemics, transportation disruptions, or any internal/external modifications hindering normal and predictable execution of sales are considered force majeure
11. Intellectual property
All technical documents, products, drawings, and photographs provided to Clients remain the exclusive property of Champagne Cuperly, sole holder of intellectual property rights over these materials, and must be returned upon request.
The Client agrees not to make any use of these materials that may infringe Champagne Cuperly’s intellectual or industrial property rights and not to disclose them to any third party.
12. Dispute resolution – Mediation
Any dispute regarding the interpretation and execution of the T&Cs is subject to French law.
In accordance with Articles L. 111-1, L. 612-1, and L. 616-1 of the Consumer Code, the Client is informed that they can use a consumer mediator free of charge for amicable resolution of disputes with Champagne Cuperly, after attempting resolution through a written complaint to Champagne Cuperly.
In accordance with Article L 616-2, the Client is also informed of the European online dispute resolution platform at https://ec.europa.eu/consumers/odr and the possibility of using it to settle disputes via an out-of-court entity.
13. Enforceability and modification of the T&Cs
Enforceability: The T&Cs are enforceable against the consumer who acknowledges having read and accepted them without reservation by checking the box provided before placing an order.
Invalidity and Modification: The invalidity of a contractual clause does not invalidate the T&Cs.
Champagne Cuperly reserves the right to modify these T&Cs, with such modifications not applying to orders placed before the changes.
14. Competent jurisdiction
Any dispute not resolved amicably or through mediation shall fall under the exclusive jurisdiction of French courts.
